SECTION 120:10-17-10. Miscellaneous provisions

- (a) Whenever a building permit is issued without the required landscape plan or approved in an inappropriate planting season for all or a portion of the landscape materials, the property owner shall submit an affidavit to the Commission certifying a landscape plan will be submitted or that the required plantings will be installed within 6 months of the date of the affidavit. If at the end of the 6 month period, the plan has not been submitted or the plantings installed, the property owner shall be in violation of this Subchapter.(b) Any off-street parking lot landscape plan that is not in compliance with a permit approved prior to the promulgation of this subchapter is subject to and must comply with the requirements of this subchapter.(c) Any landscape plan for parking areas in the State Capitol Complex Subdistrict must also comply with the rules for State Capitol Park as established in OAC 260:60.(d) Any off-street parking area that is expanded, reconfigured or newly constructed shall comply with the requirements of OAC 120:10-17.
