SECTION 150:15-7-5. Review and appeals process

  • (a)   Applicants for Small Cities Community Development Block Grants may review their application and the funding decision made by the Department.
    (b)   Appeals shall not introduce new documentation that would change the basis on which a funding decision was made. Additionally, requests for appeal shall be made within thirty (30) days after the applicant has been notified that the application will not be funded.
    (1)   Citizen appeals of local government decisions must be made at the local level. An application which would have been funded but for a technical error in ranking will be funded as soon as sufficient Community Development Block Grant-Community Development funds become available, provided the proposed grant project remains viable and eligible.
    (2)   Appeals of departmental funding decisions regarding the economic development set-aside must be made by the sponsoring unit of local government. The Department will consider appeals of its economic development funding decisions only when the results of economic viability reviews are at issue. An application which would have been funded but for a technical error in the viability review will be funded as soon as sufficient Community Development Block Grant-Economic Development funds become available, provided the proposed project remains viable and eligible.
