SECTION 150:25-5-1. Violations

Latest version.

  The following shall constitute a violation of the Minority Business Development Fund program and procedures:
(1)   Provision of false information in the request for proposal process or in projects reports; or
(2)   Failure to comply with federal or state statutes or the Department of Commerce's rules and regulations; or
(3)   significant deviation from the grant contract; or
(4)   Expenditure of funds in an unlawful manner or contractually prohibited manner; or
(5)   Fraud, waste or mismanagement of any current or prior state or federally funded contract; or
(6)   Substantial non-compliance or non-conformance with the terms of the contract.
