SECTION 165:10-3-13. Water pollution prevention in tanks; protection of migratory birds

(a) Tanks for drilling mud or deleterious substances used in the drilling, completion, or recompletion of wells shall be constructed and maintained so as to prevent pollution of surface and subsurface fresh water.
(b) The protection of migratory birds shall be the responsibility of the operator. Therefore, the Conservation Division recommends that to prevent the loss of birds due to oil, all open top tanks containing oil on the surface be protected from access to birds.
