SECTION 165:20-10-2. Definitions

- The following words and terms, when used in this Subchapter, shall have the following meaning, unless the context clearly indicates otherwise:"DOT" means the United States Department of Transportation,"Gathering pipeline unit" means the portion of the nonregulated gathering pipeline involved in the incident not to exceed one mile of pipeline."Non-DOT gathering pipeline incident" means any of the following events:(A) An event that involves a release of gas from a gathering pipeline unit and that results in one or more of the following consequences:(i) A death, or personal injury necessitating in-patient hospitalization;(ii) Estimated property damage of $50,000.00 or more, including loss to the operator and others, or both, but excluding cost of gas lost; or(iii) Unintentional estimated gas loss of three million cubic feet or more.(B) Any other event that is significant in the judgment of the operator, even though it did not meet the criteria of paragraph A.
