SECTION 165:5-1-13. Technical failures

(a) The criteria for declaring a technical failure of the Electronic Filing System shall be posted on the Commission's website.
(b) A filer whose filing is made untimely as the result of a technical failure of the Electronic Filing System may seek appropriate relief from the Commission. Failures not originating with the Electronic Filing System, such as phone line problems, problems with the filer's Internet service provider, or hardware or software problems, will not constitute a technical failure or excuse an untimely filing. The Commission may grant appropriate relief regarding an untimely filed document.
