SECTION 165:70-7-2. Deficiency procedure

- (a) If the Director finds the application package and/or supplemental package of a Class C or D utility are not in substantial compliance with the requirements of this Chapter, the Staff Response shall state the filing is a deficient filing. The deficiencies and the requirement(s) necessary to cure the deficiencies shall be stated in the Staff Response.(b) Unless the utility and the Staff resolve a dispute regarding whether the filing is a deficient filing within seven (7) business days of the Staff Response, such dispute may be submitted to the Commission en banc for resolution.
