SECTION 230:35-5-175. Uniformed services or overseas voter

- (a) Some persons may be entitled to vote a provisional ballot and to have that ballot counted without being registered if they are eligible to become registered voters, if they are residents of the precinct, if they provide proof of identity as outlined in 230:35-5-55, and if they also meet one of the following requirements.(1) The person was honorably discharged from the uniformed services of the United States and has returned home 90 days or less before the election.(2) The person is on officially authorized leave from theuniformed services of the United States and has returned home 90 days or less before the election.(3) The person was terminated or is on leave from his or her service or employment overseas and returned home 90 days or less before the election.(4) The person is the spouse or dependent of a person described in (1), (2) or (3) of this subsection.(b) Follow the provisional voting procedure in 230:35-5-177.(c) Uniformed services and overseas voters who cast a provisional ballot as outlined in (b) of this Section are required to swear by signing the Oklahoma Provisional Ballot Affidavit that they are eligible to cast the provisional ballot for one of the reasons outlined in (a) of this Section.
