SECTION 252:410-21-1. General provisions

- (a) Scope and applicability. This Subchapter incorporates by reference federal requirements for the use and management of radionuclides which have been designated by the federal Environmental Protection Agency as hazardous air pollutants. Any owner or operator of a stationary air quality source for which a radionuclide standard is prescribed must comply with the provisions of this Subchapter. Owners and operators may also be required to obtain a DEQ-issued air quality operating permit in accordance with 252:100, Air Pollution Control.(b) Incorporations. The regulations incorporated by reference into this Subchapter as rules of the DEQ are from Title 40 of the Code of Federal Regulations, Part 61, National Emission Standards for Hazardous Air Pollutants (NESHAP) as referenced by date in 252:410-1-7.(c) Effective date. This Subchapter shall become effective when the USEPA delegates authority to the DEQ for radionuclide NESHAP.(d) Extent of incorporations. Each cited federal regulation is incorporated by reference in its entirety unless specified otherwise.(e) Interfacing terms. "Administrator" as used in 40 CFR 61 shall mean the DEQ's Executive Director.
