SECTION 252:410-7-33. eciprocity recognition approval and duration

- (a) Approval. Applications for reciprocity recognition shall be deemed approved and issued by DEQ unless DEQ sends written notice of denial or a request for additional information to the applicant within 30 days after the date the application was received by DEQ. DEQ may deny a recognition, approve recognition with restrictions or amend a recognition for cause, including written notice from another licensing entity that the entity has taken enforcement action against the applicant for failure to comply with the terms of the corresponding authorization issued by the entity.(b) Duration.(1) DEQ recognitions are valid for one (1) year from the date of approval. Recognitions authorize up to 180 days of radiation activities in the state during that year.(2) The recognition will remain effective for such period of time as the registrant remains in compliance with the terms of the recognition and this Chapter, and the underlying primary authorization remains valid and has neither expired nor been suspended or revoked by the issuing entity.(c) Revocation; suspension. DEQ may revoke or suspend a reciprocity recognition for failure to comply as described in 252:410-1-5. Notice of the revocation may be given by DEQ to out-of-state authorizing entities.(d) Action by reciprocating entities. Written notice received by DEQ regarding enforcement actions that are taken by another entity against a DEQ authorized person for violations of corresponding radiation management authorizations is subject to the Oklahoma Open Records Act, 51 O.S. § 24A.1 et seq.
