SECTION 252:410-7-4. Authorization determinations

- (a) Application review. Each application is subject to DEQ review provisions of OAC 252:4, Rules of Practice and Procedure, Subchapter 7.(b) Criteria for issuance or acceptance. DEQ may deny any application in writing for cause as established by this Chapter and/or the issuance/denial criteria of 252:4-7-1.(c) Amendment/modification. DEQ may, for cause or upon the applicant's request, add conditions to any authorization or amend or modify any existing authorization.(d) Consent to conditions. Beginning radiation management activities under an authorization constitutes consent by the holder to all conditions to which the authorization is subject.(e) Severability. The provisions of any authorization are severable. If a provision thereof is invalidated by a court of law, the remaining provisions shall remain valid.
