SECTION 252:641-1-4. Operation, repairs and maintenance

- (a) Proper operation. The owner of an on-site sewage treatment system shall ensure that the system is maintained and operated properly so that:(1) sewage or effluent from the system is properly treated and does not surface, pool, flow across the ground or discharge to surface waters;(2) septic tanks, lift stations, low pressure dosing tanks, flow equalization tanks, aerobic treatment units and lagoons shall be maintained so that they do not leak or overflow; and(3) the required security measures are intact (e.g., required fences, septic tank lids, manhole covers are properly secured).(b) Malfunctioning systems. If an on-site sewage treatment system malfunctions, the person owning or otherwise responsible for the system shall take prompt action to repair the malfunctioning system, prevent further violations and remediate the site.
