SECTION 310:257-3-2. Demonstration

- Based on the risks inherent to the food operation, during inspections and upon request the certified food manager or person in charge shall demonstrate to the Department knowledge of foodborne disease prevention, application of the Hazard Analysis Critical Control Point principles, and the requirements of this Chapter. The person in charge at the time of the inspection shall demonstrate this knowledge by:(1) Complying with this Chapter by having no priority items during the current inspection; or(2) Being a certified food protection manager who has shown proficiency of required information through passing a test that is part of an accredited program; or(3) Documenting or demonstrating the implementation of operating procedures as specified in 310:257-15-7(5) and 310:257-15-7(6):(A) Employees are trained to comply with this Chapter, including awareness of major food allergens, as necessary to perform their assigned duties; and(B) Food preparation activities are directed and corrective action is taken as needed to protect the health of the consumer; and(C) In-house self inspections of daily operations are conducted on at least a daily basis to ensure that food safety policies and procedures are followed.
