SECTION 310:281-1-4. General regulatory requirements

  • (a)   Records. Each permittee shall maintain records showing the receipt, transfer, and disposal of all diagnostic x-ray systems. Additional record requirements are specified elsewhere in these regulations.
    (b)   Inspections.
    (1)   Each permittee shall afford the Department at all reasonable times opportunity to inspect diagnostic x-ray systems and the premises and facilities wherein such diagnostic x-ray systems are used or stored.
    (2)   Each permittee shall make available to the Department for inspection, upon reasonable notice, records maintained pursuant to these regulations.
    (c)   Tests. Each permittee shall perform upon instructions from the Department, or shall permit the Department to perform, such reasonable tests as the Department deems appropriate or necessary to ensure safety including, but not limited to, tests of:
    (1)   facilities wherein diagnostic x-ray systems are used or stored;
    (2)   radiation detection and monitoring instruments; and
    (3)   other equipment and devices used in connection with utilization or storage of permitted diagnostic x-ray systems.

    (g)   Prohibited uses.
    (1)   Fluoroscopic screens used in conjunction with a source of radiation shall not be held by an individual.
    (2)   The intentional exposure of persons to ionizing radiation by persons other than licensed practitioners of the healing arts or persons acting under their direction is prohibited.
    (h)   Communications. All communications and reports concerning these regulations, and permit applications or registration filed thereunder, should be addressed to the Oklahoma State Department of Health, Consumer Protection Division, 1000 N.E. 10th Street, Oklahoma City, Oklahoma, 73117-1299.
    (i)   Severability. Should any of these regulations be declared unconstitutional or invalid for any reason, the remainder of the regulations shall not be affected thereby.
