SECTION 310:410-3-15. Denial of authorization

- (a) Application for authorization as a WIC retail vendor shall be denied when the Commissioner of Health or designee finds that an applicant does not meet any of the criteria set forth.(b) When the Commissioner of Health or designee determines that the application for authorization as a WIC retail vendor is to be denied, the department shall notify the applicant. The notice to the applicant shall be in writing and shall include:(1) a clear and concise statement of the basis for denial. The statement shall include a citation to the USDA WIC Regulations or the provisions of this Subchapter for which the application is being denied.(2) a description of the right of the applicant to appeal the denial of the application within fifteen (15) calendar days of receipt of the letter and the right to a hearing.(c) Hearings under this section shall be conducted in accord with OAC 310:002 and the Administrative Procedures Act.
