Chapter 70. Objections and Protests; Hearings and Appeals |
SECTION 325:70-1-12. Horse to be disqualified on valid protest
Latest version.
- If a protest against a horse which has run in a race is declared valid, that horse may be disqualified. A horse so disqualified is a starter in the said race, and may be placed last in the order of finish or may be unplaced. The Stewards or the Commission may order any purse, award or prize for any race withheld from distribution pending the determination of the protest(s). In the event any purse, award or prize has been distributed to a person on behalf of a horse which by protest or other reason is disqualified or determined not to be entitled to such purse, award or prize, the Stewards or Commission may order such purse, award or prize returned and redistributed to the rightful person. Any person who fails to comply with an Order to return any purse, award or prize previously distributed shall be suspended until its return.
