SECTION 325:80-5-5. Conditions of a Racetrack Gaming Operator License

- In addition to conditions imposed in any conditional license issued by the Commission, the original and/or renewal licenses issued by the Commission are subject to the following conditions:(1) With respect to a Racetrack Gaming Operator Licensee, the Licensee will at all times make its Gaming Facility and Racetrack Premises available for inspection by the Commission or the Oklahoma State Auditor and Inspector or their authorized representatives, with or without prior announcement. Additionally, the Licensee understands that a Gaming Agent is authorized to be present anywhere within the Gaming Facility each day any time during operation of the Gaming Facility, and whenever else deemed appropriate by the Commission Director of Law Enforcement.(2) The Licensee consents to the examination of all accounts, bank accounts, and records of, or under the Control of the Licensee, or any entity in which the Licensee has a direct or indirect Controlling interest. Upon request of the Commission or its authorized representative, the Licensee must authorize all third parties in possession or Control of the requested documents to allow the Commission or the Oklahoma State Auditor and Inspector or their representatives to examine such documents.(3) The Licensee accepts all risks of adverse public notice, embarrassment, criticism, damages, or financial loss that may result from any disclosure or publication of material or information supplied to the agency in connection with any application to the Commission.(4) The Licensee will be responsible for all applicable registration, taxation, and licensing imposed by the Act or other State law upon the license, Gaming Machine, or associated equipment.(5) The Licensee shall observe and enforce the Rules. The gaming license is granted on the condition that the Licensee, its officials, its employees and its concessionaires shall obey all decisions and orders of the Commission. Each Licensee shall have a continuing duty to report to the Commission Law Enforcement Division any violation of the Rules or applicable Laws of the State of Oklahoma by the Licensee, its officials, its employees or other occupational licensees, and its concessionaires. Failure to report violations will result in disciplinary action against the Licensee.
