  • (a)   For contacts which were effective prior to October 2, 1995, OHFA is liable for unpaid rent and damages if the family vacates during the allowable 12 months after the last HAP payment. OHFA must perform all of the functions normally required, such as inspections and reexaminations. The participant will be notified of the right to remain on the program at $0 assistance for 12 months. If the family is still in the unit after 12 months, the assistance will be terminated.
    (b)   For contracts effective after October 2, 1995, OHFA has no liability for unpaid rent or damages, and the family may remain in the unit at $0 assistance for up to 180 days after the last HAP payment. If the family is still in the unit after 180 days, the assistance will be terminated. If within the 180 day time frame an owner rent increase or a decrease in the TTP cause the family to be eligible for a HAP payment, OHFA will resume assistance payments for the family.
    (c)   In order for a family to move to another unit during the 180 days, the rent for the new unit would have to be high enough to necessitate a housing assistance payment.
