SECTION 340:100-3-2. Client records, confidentiality and security

  •   Each DDSD area office shall maintain an official Client Office Record for each client receiving DDSD services in their respective areas.
    (1)   All records and information regarding a client are confidential and shall be released only to individuals or agencies who have proper authorization from the client/legal representative.
    (2)   It is the legal responsibility of Department employees and contract providers to protect the privacy of clients, and to ensure the protection of confidential information.
    (3)   Each facility/service area shall ensure that the client's records are protected from loss, defacement, tampering, destruction, and violation of confidentiality.
    (4)   DDSD personnel shall obtain individualized, time-limited, informed consent, prior to securing client records/information from agencies that are neither part of nor under contract with the DHS.
