SECTION 340:75-1-16.1. Right to be heard and hearing notification to placement providers

- (a) Per Section 1-4-807 of Title 10A of the Oklahoma Statutes (10A O.S. § 1-4-807), a foster parent, group home, pre-adoptive parent, or relative providing care for the child in the Oklahoma Department of Human Services (DHS) custody has a right to notice of court proceedings regarding the child and the right to be heard at all proceedings. Except when allowed to intervene, the foster parent, group home, pre-adoptive parent, or relative providing care for the child is not considered a party to the juvenile court proceeding solely because of the right to notice and the right to be heard at the proceeding.(b) Per 10A O.S. § 1-9-119, the foster parent:(1) receives a notification of any court hearing including the date and time, the judge or hearing officer's name, the hearing's location, and the case's court docket number; and(2) is kept informed of decisions concerning the child made by the court, DHS, or the child-placing agency.
