SECTION 35:3-1-12. Livestock auction markets

- (a) Conducting a livestock auction market without a valid bond pursuant to the Livestock Auction Market Act.(1) First violation - $1,000 to $5,000(2) Second violation - $2,500 to $7,500(3) Subsequent violations - $5,000 to $10,000(b) Failure to properly deposit custodial funds.(1) First violation - $100 to $500(2) Second violation - $250 to $750(3) Subsequent violations - $500 to $10,000(c) Improper disbursement of custodial funds.(1) First violation - $100 to $500(2) Second violation - $250 to $750(3) Subsequent violations - $500 to $10,000(d) Shortages in custodial accounts.(1) First violation - $250 to $1,000(2) Second violation - $500 to $3,000(3) Subsequent violations - $1,500 to $10,000(e) Failure to keep adequate records.(1) First violation - $100 to $500(2) Second violation - $250 to $750(3) Subsequent violations - $500 to $10,000(f) Failure to comply with any other provision of the Livestock Auction Markets Act.(1) First violation - $100 to $500(2) Second violation - $250 to $750(3) Subsequent violations - $500 to $10,000(g) Each day a violation is committed or continues is deemed to be a separate offense.(h) In no event shall this fine matrix limit the imposition of a different penalty when circumstances require.
