SECTION 375:20-1-4. Special instructions - weapons

- (b) Upon leasing any weapon, the agency will insure it receives a complete technical inspection by a qualified armorer. OSBI will not be responsible for malfunctioning or misfiring weapons. OSBI will provide an armorer's report to the leasing agency.(c) Weapons leased to agencies shall not be utilized for personal use or loaned to any other law enforcement agency. They shall be exclusively for use in enforcing the provisions of the Uniform Controlled Dangerous Substance Act [63:2-101 et seq.](d) All firearms leased will be utilized only by CLEET certified personnel who have received training in the type and class of weapons leased.(e) Leasing agencies shall provide the Bureau with a monthly report concerning the utilization of leased weapons. This report shall include the following information:(1) type of weapon(s) leased/date;(2) where/when fired;(3) number and type of rounds utilized during each firing (e.g., standard ball, tracer, etc.);(4) conditions during firing (e.g., night fire, familiarization, qualification, actual operation);(5) any malfunctions, stoppages, or misfires;(6) certification of cleaning; and(7) comments.(f) Weapons requiring more than routine maintenance shall be returned to the OSBI for service by OSBI armorers.
