SECTION 375:8-7-33. OSHA supplementary record

  •   United States Department of Labor OSHA Form No. 101 or equivalent maintained to record supplementary information about "recordable" injuries and illnesses as defined in 29 CFR, §1904.1 et seq. shall be retained in office for five (5) years "following the end of the year to which they relate" (29 CFR, §1904.6) then retained or destroyed at the discretion of the Director provided no legal action is pending. If legal action involving the records is pending, the records shall be retained until the exhaustion of all legal remedies, then retained or destroyed at the discretion of the Director.
