SECTION 376:10-1-9. Objections and rulings upon evidence

  • (a)   In investigating a complaint, the Council shall permit the introduction of evidence that is competent, relevant and material.
    (b)   Because of the investigatory nature of the Council on Judicial Complaints, strict adherence to the rules of evidence shall not be required. The Council shall follow the Oklahoma rules of evidence to the extent possible while preserving the investigatory nature of the complaint process. Under no circumstances shall a witness to an investigation be required to provide evidence that is constitutionally protected.
    (c)   The Chair shall rule upon all objections and upon the admissibility of evidence arising in the course of a hearing.
