SECTION 390:2-1-6. Service of subpoenas; motion to quash

- (a) A subpoena may be served by a law enforcement officer, by an attorney, or by any other person who is over eighteen (18) years of age. The person serving the subpoena shall attach an affidavit showing the person served, and the time and manner of service. Service may be made in person, by certified mail, with return receipt, by leaving a copy of the subpoena at the principal place of business of the party, with the party, or an employee who customarily serves as the secretary or receptionist of the party. Service may also be made in any other manner provided by law. A subpoena shall be served on a witness not less than three (3) days prior to the hearing.(b) The original subpoena, with affidavit of service thereon, shall be filed with CLEET. The attendance of a witness shall not be enforced unless the original subpoena is on file at the time of the hearing.(c) Any person to whom a subpoena is directed, may file a motion to quash or limit the subpoena, setting forth the reasons why the subpoena should not be complied with or why it should be limited in scope.
