SECTION 390:35-9-1. Classifications of actions against licensees

- (a) Pursuant to the Act, CLEET shall have the responsibility and authority to investigate alleged violations of the Act and of the rules of this Chapter.(b) These investigations may result in one or more of the following classifications of actions to be taken against a licensee:(1) Written reprimand, without probation;(2) Written reprimand, with probation;(3) Suspension of license or identification card;(4) Revocation of license or identification card;(5) Denial of license application;(6) Non-renewal of license;(7) Arrest; and/or(8) Disciplinary penalty or fine.(c) A licensee may choose to voluntarily surrender his or her license(s) or identification card while subject to an investigation into, or a pending or concluded proceeding involving, allegations of violation of any of the provisions of the Act or CLEET rules. Such voluntary surrender will be treated as a revocation of said license(s) or identification card. Any licensee who voluntarily surrenders his or her license(s) or identification card under such circumstances shall not be eligible to apply for a new license under the Act until five (5) years have passed from the date of such voluntary surrender.
