SECTION 390:60-11-6. Use of force

- (1) the Bail Enforcer has made a lawful command for the defendant to surrender and the defendant has refused to obey; OR(2) the Bail Enforcer must use force to defend the Bail Enforcer or another from injury or threat or injury while recovering a defendant.(b) Any force used may not be more than sufficient to prevent an offense.(c) No force may be used which is more than sufficient to temporarily restrain a defendant who has refused to obey a lawful command to surrender to the licensed Bail Enforcer.(d) The manner and duration of force used by a Bail Enforcer may not be more than that reasonably necessary to surrender the defendant to a public officer competent to receive the defendant into custody.
