SECTION 395:10-1-15. Qualified Domestic Order - QDRO'S

  • (a)   No Qualified Domestic Order shall be processed or acted upon by the System unless such order specifically complies with the statutory provisions of O.S. section 2-303.3.
    (b)   When review for sufficiency is requested by a party submitting any Qualified Domestic Order, such review shall be performed by attorneys for the Board at the rate of $100.00 per hour (a minimum of two (2) hours) payable to the System.
    (c)   The Oklahoma Law Enforcement Retirement System shall submit only that information which reflects the member's contribution history and /or benefit amount.
    (d)   Said information shall not be furnished to any person unless prior written consent of the member is obtained or a subpoena or court order is issued by a court of competent jurisdiction.
    (e)   In the event the Qualified Domestic Order does not state otherwise, whenever a retired member receives a cost of living adjustment, the alternate payee will be entitled to a cost of living adjustment commensurate with the alternate payee's proportion of the total monthly pension amount.
