SECTION 422:15-5-6. Order of assessment

- (a) After review and consideration of all evidence presented and upon a majority vote of the Commission, the Commission may issue an Order of Assessment commanding the remittance of assessments owed and imposing such penalties as may be provided by law. The Order shall include findings of fact and conclusions of law, and shall otherwise satisfy the requirements of the APA. The Order of Assessment shall be a final order appealable under the APA.(b) Any Respondent or other person who fails to appear as directed, after service of the petition and notice of hearing as provided by these rules, may be determined to have waived the right to appear and present a defense to the allegations contained in the petition. A final order in such proceeding may be issued by the Administrative Law Judge or the granting by default the relief prayed for in the petition.(c) Any dispute over the remittance of an assessment may be resolved by an agreed settlement or consent order, with the approval of a majority of the Commission.
