SECTION 432:10-3-4. Affidavit
Latest version.
- An affidavit attesting to the accuracy of the Refund request, including the Refund amount requested, and a statement certifying to the Commission that the party seeking a Refund is the owner of the oil, natural gas or condensate for which the Refund is request must accompany the request. The affidavit shall be notarized and shall be sworn to and signed by the party seeking the Refund under penalty of law. In the event an agent of the owner of the production or production proceeds requests the Refund, a power of attorney or other documentation demonstrating the agent's authority to act on behalf of the owner must be attached to the affidavit.
