SECTION 455:10-1-9. Request for declaratory ruling

- (a) Any person directly affected by a Commission final or addendum decision may file a request for a declaratory ruling to explain or clarify the order in relation to a particular situation. The Commission shall not entertain a request based on hypothetical or speculative situations.(b) Any person may file a request for interpretation or applicability of any rule adopted by the Commission.(c) A request for a declaratory ruling shall be made in writing and shall include the following information:(1) the name, address and telephone number of the person making the request;(2) the name, address and telephone number of the agency or organization the person represents, if any;(3) a description of the problem or issue that is the basis for the request;(4) a statement of the facts and questions the person may have; and(5) the identification of the specific order or rule on which the declaratory ruling is being sought.(d) A request for declaratory ruling submitted pursuant to this section shall not automatically stay enforcement of the final or addendum order or otherwise suspend any applicable time limits.
