SECTION 460:3-5-7. Summary disposition

- (a) In a proceeding for suspension or revocation of a permit under this Subchapter, where the permittee fails to appear at a hearing, the permittee shall be deemed to have waived its rights to a hearing and the hearing examiner may assume for the purpose of the proceeding that:(1) Each violation listed in the Show Cause Order occurred;(2) Such violations were caused by the permittee; and(3) Nothing herein shall authorize a permitee to dispute the fact of the violations and orders contained within the Show Cause Order, so long as said violations or orders have become final.
