SECTION 585:2-7-12. Burden of proof

Latest version.

The charging party, in asserting an unfair labor practice under the FPAA, shall have the burden of going forward and of proving the allegations by a preponderance of the testimony taken. The party raising any subsequent issue shall have the burden of proving that issue by a preponderance of the testimony taken.
