SECTION 710:10-5-1. Status as of January first governs; exception

  • (a)   In order to obtain a homestead exemption, the applicant must be the record actual owner of the property on January 1st and must actually be residing there. If the evidence of title is not executed on or before January 1st and filed of record in the office of the County Clerk on or before February 1st, no exemption can be allowed, even though the person may have owned the property and may have been residing there for a number of years.     (b)   A natural person actually owning, residing and domiciled in the residence on January 1st shall be deemed to be the record owner of the property on January 1st, if the deed or other evidence of ownership, executed on or before January 1st, is of record in the office of the County Clerk on February 1.
