SECTION 725:30-4-13. Property

  • (a)   Prohibited activities. The following are prohibited in state parks:
    (1)   Abandoning property.
    (2)   Leaving property unattended for longer than 48 hours, except when authorized by permit from the park manager in accordance with the conditions set out therein.
    (3)   Failing to turn in found property to the park manager or park ranger as soon as practicable.
    (b)   Impoundment of property.
    (1)   Property left unattended in excess of an allowed period of time may be impounded by park officials.
    (2)   Unattended property that interferes with visitor safety, orderly management of the park area, or presents a threat to natural resources may be impounded by park officials.
    (3)   Found or impounded property shall be inventoried to determine ownership and safeguard such property.
    (4)   The owner of record is responsible and liable for all charges to the person who has removed, stored or otherwise disposed of property impounded pursuant to this section; fees may be charged at the discretion of the park manager for the impoundment and storage of property impounded pursuant to this section.
    (5)   Impoundment of motor vehicles and boats shall be conducted in accordance with state law.
    (c)   Disposal of property.
    (1)   Unattended property impounded pursuant to this section shall be deemed to be abandoned unless claimed by the owner or an authorized representative thereof within 60 days. The 60 day period shall begin when the rightful owner of the property has been notified, if the owner can be identified, or from the time the property was placed in the park manager's custody, if the owner cannot be identified.
    (2)   Unclaimed found property shall be stored a minimum of 60 days and, unless claimed by the owner or an authorized representative thereof, may be claimed by the finder, provided that the finder is not an employee of the Oklahoma Tourism and Recreation Department, Division of State Parks. If a finder claims such property the finder shall be responsible for any fees associated with such claimed property. Found property not claimed by the owner or an authorized representative or the finder shall be deemed abandoned.
    (3)   All unclaimed abandoned property shall become the property of the Oklahoma Tourism and Recreation Department, Division of State Parks and shall be disposed of in the following manner:
    (A)   Property which can be utilized for official state park business shall be inventoried pursuant to procedure as state park property by the state park unit where the property was abandoned and utilized by that park unit or any other park unit where such property may be applicable.
    (B)   Property which cannot be utilized for official state park business more shall be inventoried pursuant to procedure as state park property by the state park unit where the property was abandoned and liquidated at the next Oklahoma Tourism and Recreation Department's sponsored auction.
