SECTION 785:10-9-2. Notice of hearing for formation of irrigation district

(a)   Upon receipt of a petition for formation of irrigation district the Board shall set a date for a hearing thereon before a hearing officer in a place of general convenience at the nearest county seat. The Board shall instruct the petitioners to publish, at their expense, notice of saied hearing by legal publication for two (2) consecutive weeks in a newspaper of general circulation published in each county containing lands within the boundaries of the proposed district. The hearing date shall not be earlier than thirty (30) days after the last publication date of said notice. [82:277.4]

(b)   Notice of such hearing shall also be given by registered or certified mail by the petitioners to the electors whose names and addresses are shown on the petition at least thirty (30) days before the date of the hearing.

(c)   The notice shall contain a brief statement describing the purpose of the hearing and a description of the land to be included within the proposed district and such other matters as required by law.
