SECTION 785:25-3-4. Dams considered unsafe and menace to life and property

- (a) In determining whether a dam is unsafe and a menace to life and property [82:105.27] under the provisions of Section 105.27 of Title 82 of the Oklahoma Statutes and the corrective actions necessary to put a dam in a safe condition, the Board shall review the requirements set forth in rules of this Chapter, and recommendations on matters which directly affect the integrity of dams set forth in DESIGN OF SMALL DAMS (1977) and DESIGN OF GRAVITY DAMS (1976), published by the U.S. Department Interior Bureau of Reclamation (BOR), ENGINEERING AND DESIGN MANUALS, SERIES EM-1110, published by the U.S. Department of the Army, Corp of Engineers (COE), the ENGINEERING FIELD MANUAL and TECHNICAL RELEASE NO. 60, published by the U.S. Department of Agriculture, Natural Resources Conservation Service, or equivalent recommendations.(b) Existing dams which are in imminent peril of failure shall be considered unsafe and a menace to life and property [82:105.27] under the provisions of Section 105.27 of Title 82 of the Oklahoma Statutes.
