SECTION 785:4-7-1. Opening of hearings and general supervision of hearings

- (a) The Hearing Examiner shall open the hearing at the time and place scheduled by the Hearing Examiner. The Hearing examiner shall state the purpose of the hearing and read and admit into evidence and the record the following:(1) The application which initiated the proceeding;(2) The notice of application;(3) The affidavit of publication or other proof of service of notice required by law;(4) All other pleadings and documents submitted; and(5) Any protests which have been filed.(b) Hearing Examiners shall have general supervision over the manner in which the hearings are held, requiring the degree of formality necessary to provide due process for all parties. Hearing Examiners may limit or prohibit distractions, such as cameras, lights, posters, vocal outbursts, etc. as deemed appropriate under the circumstances.
