SECTION 800:25-34-5. Auction agreement

- The organization(s) selected and the Department shall enter into an agreement on the auction and the expenditure of funds raised by the auction. At minimum, the agreement shall include the following terms:(1) All proceeds owed to the Department shall be transferred on or before the tenth day of the month following the auction;(2) The organization shall provide the name, address, phone number, and physical description of the individual to whom the special permit was sold;(3) The organization will agree to arrangements for the deposit of proceeds, payment for services rendered, accounting procedures, and audit as requested by the Department;(4) Unless his/her hunting privileges have been revoked pursuant to law, any resident or nonresident qualified to hunt in Oklahoma is eligible to purchase a special permit be auction bid. The organization shall ensure no discrimination against any person on the basis of race, creed, color, national origin, religion, sex, age, marital status, or disability.(5) Any special permit may be transferred, but not sold or bartered, by the successful bidder, one time only, to one individual eligible to hunt. The transfer shall not be conducted for financial gain of the successful bidder, or any other person, or the permit shall be voided and the funds will not be refunded. The Department must be notified of the transfer prior to the permit being issued.(6) The Department retains the right to publicize the results of the auction in any manner it deems appropriate.
