Editor's Note: Effective 7-1-17, the Legislature enacted Senate Bill 668, which revised legislation enacted the previous year in Senate Bill 1388, effective 7-1-16, as it related to the disposition of the rules of the abolished Scenic Rivers Commission (see Editor's Note below), as follows:• Eliminated the 7-1-16 provision that would have terminated the Scenic Rivers Commission rules on 7-1-17 "unless earlier superseded by rules promulgated by the [Grand River Dam] Authority" [Laws 2016, c. 297, § 5(D)].• Specifically transferred Chapters 10 and 15 of the Scenic Rivers Commission's Title 630 to the Grand River Dam Authority, as opposed to transferring "all rules of the Scenic Rivers Commission" [Laws 2016, c. 297, § 5(D)], as had been previously set forth in the 7-1-16 legislation.As of the 8-15-18 cutoff date for the 2018 OAC Supplement, the Grand River Dam Authority had not promulgated rules in its Title 300 to implement the provisions in the 2016 or 2017 legislation.For additional information, see Laws 2017, c. 41, § 2 and Laws 2016, c. 297, § 5.For the rules of the Grand River Dam Authority, see Title 300 in the 2016 Edition of the OAC, as well as updates to Chapter 35 (Lakes Rules) published in the 2017 OAC Supplement and re-published in the 2018 OAC Supplement. Editor's Note: Effective 7-1-16, the Scenic Rivers Commission was terminated, and "the rights and authorities of the Scenic Rivers Commission [were] transferred to the Grand River Dam Authority" [Laws 2016, c. 297, § 4(A)]. Further, "with regards to all rights and authorities transferred to the Grand River Dam Authority . . . , all rules of the Scenic Rivers Commission relating to licensing, use permits and protection of natural resources [see OAC 630], are hereby transferred to the Grand River Dam Authority to the extent the rules are consistent with state law and rules of the Authority for the purpose of implementing and enforcing the provisions of the Scenic Rivers Act. The rules shall remain in effect only until July 1, 2017, at which time the transferred rules will terminate unless earlier superseded by rules promulgated by the Authority." [Laws 2016, c. 297, §5(D)] As of the 8-15-16 cutoff date for the 2016 Edition of the OAC, the Grand River Dam Authority had not promulgated rules in this Title 300 to supersede the Scenic River Commission's rules in Title 630.
