SECTION 150:25-5-3. General responsibilities

(a) A contractor receiving state appropriated funds shall be responsible for taking all action necessary to meet the terms of its contract for such funds and to enforce the terms of the contract against any private or public participant that fails to comply with applicable provisions of the agreement or any contract or documents resulting from it, and to recover on behalf of the Department of Commerce any liabilities that may arise as the result of the breach of the contract by any participant.
(b) Nothing in this section shall restrict the Department's rights to enforce independently the terms of contracts or documents resulting there from or to recover any sums that may become due as the result of a breach of such contract.
