SECTION 150:25-5-2. Corrective actions

Latest version.

  The Department of Commerce may take any or all of the following action where there has been found to be a program violation as provided in 150:25-5-1:
(1)   Withhold funds;
(2)   Reduce the total amount of the contract;
(3)   Require return of unexpended funds;
(4)   Require repayment of expended funds;
(5)   Add conditions to the contract;
(6)   Cancel the contract and recover all funds expended in an ineligible manner prior to said cancellation;
(7)   Deny future funding applications and program funding for a period not to exceed two (2) years; or
(8)   Disallow expenditures.
