SECTION 165:57-5-3. Approval of initial tariffs

- (a) No later than twelve (12) months after being granted a Certificate of Convenience and Necessity, pursuant to OAC 165:57-5-1, an operator service provider shall file an Application requesting approval of its initial tariffs, unless filed pursuant to OAC 165:57-5-1(c)(8), which include the terms and conditions of service and all rates and charges for each service classification, in a format consistent with Subchapter 5 of this Chapter.(b) All entities seeking approval of an initial tariff shall serve the file-stamped Application by mail, electronic mail, or personal service to the Oklahoma Attorney General and the Director of the Public Utility Division.(c) The initial tariffs shall not become effective except by order of the Commission after such notice and hearing, if any, as directed by the Commission.(d) No later than thirty (30) days after approval of the initial tariffs, an original and two (2) copies of the approved tariffs, which conform to OAC 165:57-7-3, shall be provided to the Public Utility Division.
