SECTION 252:515-19-1. Applicability

- (a) Active land disposal facilities. Parts 3, 5 and 13 of this Subchapter apply to all active land disposal facilities.(b) Active MSWLFs. Parts 3, 5, and 7 of this Subchapter apply to all active MSWLFs.(c) Active solid waste processing facilities. Parts 3 and 9 of this Subchapter apply to all active solid waste transfer stations and processing facilities, except used tire facilities, regulated medical waste processing facilities, and solid waste composting facilities.(1) Used Tire facilities. Used Tire facilities are subject to the requirements of Part 3 of this Subchapter, except OAC 252:515-19-33, as well as Parts 3 and 5 of OAC 252:515-21.(2) Regulated medical waste processing facilities. Regulated medical waste processing facilities are subject to the requirements of Part 3 of this Subchapter as well as Parts 3 and 5 of OAC 252:515-23, as applicable.(3) Solid waste composting facilities. Part 3 of this Subchapter applies to all active solid waste composting facilities, including composting facilities at land disposal facilities, except those exempted by OAC 252:515-43-31.(d) Borrow areas. Off-site soil borrow areas of land disposal facilities are only subject to the operational requirements of OAC 252:515-19-32, 35, 36, and 55.
