SECTION 252:616-11-6. Dust Suppression

- (a) Wastewater usage. Class III wastewater, where the pollutant of concern is TSS, can be used for dust suppression where fugitive dust control would otherwise be an air quality problem, in a manner which does not pollute or tend to pollute waters of the state of Oklahoma, the environment or pose a risk to human health.(b) Restrictions. No Class III wastewater can be used for dust suppression during periods of precipitation or when soil is saturated or frozen. Runoff of wastewater used for dust suppression is prohibited.(c) Rule exemptions. Wastewater land applied for dust suppression under this section is exempted from certain provisions of this rule as follows:(1) haul roads are not required to be fenced or contain signage, unless other safety or environmental circumstances dictate otherwise (OAC 252:616-5-1(c)).(2) haul roads are not required to have groundwater monitoring conditions (OAC 252:616-5-4).
