Latest version.
- The applicant or any party may request reconsideration of the Commissioner's decision to issue or deny a Certificate of Need. This section describes the process for reconsideration.(1) Filing a request. The request for reconsideration must be written and must be received by the Department within time frames specified by 63 O.S. Sections 1-853 or 1-880.7 if applicable. The request must demonstrate conformity to at least one (1) of the grounds for a reconsideration hearing set out in Section 317 of the Administrative Procedures Act.(2) Determining good cause. Within ten (10) days after receipt of the request, the Commissioner shall determine whether the request has shown good cause for reconsideration.
