SECTION 310:616-3-4. Confidentiality

- (a) Medical records shall be kept confidential. Only authorized personnel shall have access to the record. Written consent of the patient, the court appointed guardian, or a court order must be presented as authority for release of medical information.(b) Patient access to medical records. Any person who is or has been a patient of a physician, hospital, or other medical facility, except psychiatric, shall be entitled to access information contained in his/her medical records upon request. Request for minors may be made by parents or legal guardian. A copy of the medical record pertaining to his/her case shall be furnished upon tender of the expense of such copy or copies. The cost of each copy shall not exceed the statutory fee.
