SECTION 340:2-1-46. Confidentiality

- (a) All alcohol and drug tests and all information relating to tests, such as memoranda, reports, statements, and interviews, are confidential. All alcohol and drug testing documentation is maintained in secure files, marked confidential, and kept separate from other personnel files.(b) The review officer explains the results of a positive alcohol and drug test to employees and applicants in a private, confidential setting. Employees and applicants are also entitled to explain a positive alcohol or drug test to the review officer in a private, confidential setting.(c) Upon written request, affected employees are provided with copies of all information and records related to their testing.
