SECTION 375:45-1-5. No warranty on donated property/"As is"

Any surplus property donated by the OSBI to a Receiving Agency is donated "as is". The OSBI makes no warranty whatsoever as to the quality, value, safety, or usefulness of the property in question, including but not limited to warranties of merchantability or fitness for a particular use. The Receiving Agency shall hold the OSBI and its employees harmless from any action or claim arising from the donation of surplus property to the Receiving Agency by the OSBI or the use of such property by the Receiving Agency.
