SECTION 375:8-1-2. Definitions

- The following words or terms when used in this subchapter shall have the following meaning unless the context clearly indicates otherwise:"Agency" or "Agencies" shall mean the Oklahoma State Bureau of Investigation."Criminalistic records" shall mean all records pertaining to, documenting or reflecting efforts of the Oklahoma State Bureau of Investigation Criminalistic Services Division to provide scientific laboratory assistance to all law enforcement agencies in the discovery and detection of criminal activity. "Criminalistic records" shall not include phone logs, radio logs, phone memos, communications with and within the Legal Department of the Oklahoma State Bureau of Investigation, or other business records of the Oklahoma State Bureau of Investigation not made part of a Criminalistic Services Division case file. This definition applies only to these rules regarding record retention and destruction and shall in no way limit the rights of the Oklahoma State Bureau of Investigation to claim a record of the Oklahoma State Bureau of Investigation is confidential and not open to the public pursuant to 74 O.S., Section 150.5(D) or other statute."Director" is the Director of the OSBI or a designee."Investigative records" shall mean all records pertaining to, documenting or reflecting efforts of Oklahoma State Bureau of Investigation Investigative Services Division to detect and investigate criminal activity. "Investigative records" shall not include phone logs, radio logs, phone memos, records generated by the Criminal Intelligence Unit of the Oklahoma State Bureau of Investigation, communications with and within the Legal Department of the Oklahoma State Bureau of Investigation, or other business records of the Oklahoma State Bureau of Investigation not reduced to an investigative report or memorandum. This definition applies only to these rules regarding record retention and destruction and shall in no way limit the rights of the Oklahoma State Bureau of Investigation to claim a record of the Oklahoma State Bureau of Investigation is confidential and not open to the public pursuant to 74 O.S., Section 150.5(D) or other statute."OSBI" shall mean the Oklahoma State Bureau of Investigation."Record" means document, book, paper, photograph, micro-film, computer tape, disk, record, sound recording, film recording, video record or other material, regardless of physical form or characteristics, made or received pursuant to law or ordinance or in connection with the transaction of official business , the expenditure of public funds, or the administration of public property.
